Joel H. Feigenbaum is an Associate in the Firm's Casualty Litigation Department and Hospitality & Retail Practice Group. He defends clients in diverse matters involving general and premises liability, negligent security, product, automobile, foodborne illness, and liquor liability claims. He advocates on behalf of a variety of hospitality and retail industry clients, including hotels/motels, restaurants, franchisors/franchisees, resorts, and Fortune 500 retail chains. He also represents athletic clubs, educational facilities, carnivals, telecommunication companies, supermarkets, and hospitals in addition to working with a variety of insurers, self-insureds, and third-party administrators in defense of catastrophic injuries and losses.

Mr. Feigenbaum is an experienced litigator and manages cases from inception to trial/arbitration. This includes preparing/answering discovery and pleadings, drafting and arguing motions, witness preparation, depositions, and settlement negotiation. He has first-chair trial experience and has arbitrated cases throughout eastern Pennsylvania and in federal court. Mr. Feigenbaum also regularly assists clients in comprehensive pre-suit investigations and, when appropriate, settlement negotiation.
Since 2017, Mr. Feigenbaum has routinely served as a court-certified arbitrator for the Philadelphia Court of Common Pleas. Prior to joining Post & Schell, he worked as an associate attorney with a regional defense firm.

- Defense verdict on behalf of a condominium association and commercial real estate developer following a three-week jury trial in Chester County, Court of Common Pleas in a premises liability action over allegedly allowing dangerous transient conditions to remain on their premises, despite actual notice, resulting in a traumatic brain injury and disabling cognitive and ocular deficits, requiring lifelong medical care and the complete inability to return to work. The pre-trial settlement demand was $9.5 million.
- Successfully defended a well-known pharmacy chain in a case where its alleged failure to adequately care for a dying tree on its property led to the tree falling on a customer, causing permanent brain damage and spinal cord injuries.
- Obtained a favorable settlement on behalf of a traveling carnival where a patron fell from an amusement ride and substantial lapses in safety and operator training were alleged.
- Victorious motion to dismiss resulted in dismissal – with prejudice – of claims for emotional distress, fraud, and punitive damages in a federal breach of contract claim resulting from the inadvertent destruction of personal property.
- Successfully defended a negligent security action filed in the Philadelphia Court of Common Pleas against a prominent retailer for a nuisance value settlement where spoliation of surveillance footage was alleged.
- Defense verdict on behalf of a motorist involved in an intersectional collision where significant spinal and neurological injuries were alleged.
- Obtained dismissal of a Montgomery County grocery store from a state court action on contractual grounds where the allegedly improperly constructed walkways and curbs leading to the main entrance caused a customer to fall, sustain cervical spine fractures, and undergo fusion surgery.
