Actions related to data security and breaches continue to evolve as they keep pace with new technology and changing legal and regulatory landscapes. These actions require legal counsel who not only understand the complexities of class action litigation, but also the changing data security standards, concurrent legal and regulatory issues, and potential penalties.

The attorneys in our Data Privacy & Cybersecurity Complex Litigation Practice Group counsel and defend clients facing complex litigation and class actions related to data and cyber breaches, insufficient disclosures, and access of Personally Identifiable Information (PII) by third parties. Comprised of attorneys from our Data Privacy & Cybersecurity, Employment & Labor, Health Care, Internal Investigations & White Collar Defense, and Class Action Defense Practice Groups, our team is experienced with the technological, legal, regulatory, discovery, and timing issues crucial to defending this unique and developing area of class action litigation.

We counsel and defend clients on privacy and data breach litigation involving:

  • Alleged breaches of sensitive private data, including protected health information (PHI), Social Security Numbers, payment card information, insurance information, and other PII.
  • Alleged violations of state and/or federal privacy and cybersecurity laws, including HIPAA, the Federal Trade Commission Act (FTCA), the Red Flags Rule, the Gramm-Leach-Bliley Act (GLBA), the Stored Communications Act (SCA), Wiretap Act, Video Privacy Protection Act (VPPA), Telephone Consumer Protection Act (TCPA), Fair Credit Reporting Act (FCRA), Federal Educational Rights and Privacy Act (FERPA), Children’s Online Privacy Protection Act (COPPA), and state consumer protection laws.
  • Alleged breach of third-party or business partner data.
  • Alleged insider misconduct.
  • Alleged breaches of employee data.
