Our attorneys counsel and advise clients on workplace safety and health issues and defend employers in enforcement proceedings before the Occupational Safety and Health Administration (OSHA) and state counterparts.
Overview
Employers of all sizes and in every industry have a legal responsibility to provide a safe workplace and implement appropriate policies and procedures to protect the health and safety of employees. However, operational needs and production requirements can make it difficult for employers to navigate complex safety and health regulations. Even those employers who place the highest emphasis on safety can encounter workplace accidents, an unanticipated OSHA inspection, OSHA enforcement proceedings, and penalties.
The attorneys in our Occupational Safety and Health Group provide clients with practical guidance to develop and maintain effective workplace safety and health management programs. We provide advice on regulatory compliance, accident prevention and preparedness, safety audits, and employee training. When workplace accidents happen, we assist clients with severe injury reporting, accident investigation, and proactive preparation for an OSHA inspection. We manage the OSHA inspection process on behalf of clients, including rapid response on-site support for unannounced inspections. We also advise employers in the OSHA enforcement process, including litigation of citations and penalty assessments.
Our services include:
- Proactive counseling and compliance with federal and state health and safety requirements, recordkeeping and reporting requirements, and day-to-day workplace safety issues
- Facilitating on-site safety and health assessments and audits
- Development of workplace safety programs and policies
- Investigating workplace accidents, injuries and reports of unsafe work conditions
- On-site support and crisis management in response to catastrophic workplace incidents, serious injuries, and fatalities
- Representing employers throughout the OSHA enforcement process, including on-site representation in unprogrammed inspections arising from employee complaints and serious injury reports, negotiating and resolving citations and penalties, contesting and litigating citations, and managing abatement
- Defending OSHA whistleblower and retaliation claims.
