Paula Sanders Presents on Changes in Surveys and Enforcement for SNFs on PHCA Webinar on Aug. 25

On Tuesday, August 25, 2020, Paula G. Sanders presented on the Pennsylvania Health Care Association (PHCA) webinar, "The New Normal? Changes in Surveys and Enforcement," at 3:00 PM ET.

On August 17, 2020, the Centers for Medicare and Medicaid Services (CMS), issued revised guidance to state survey agencies regarding survey enforcement and prioritization activities. In an environment where CMS is touting the increased number of immediate jeopardy citations and federal civil money penalties (CMP) in excess of $15 million, skilled nursing facilities (SNF) need to understand what lies ahead and how to prepare for this new onslaught of heightened scrutiny.

Ms. Sanders presentation included:

  • Explaining how CMS expects states to resolve surveys that occurred or remained open during the prioritization period (March 23, 2020 through May 31, 2020).
  • Providing strategies for preparing effective plans of correction and possible desk audits for compliance.
  • Comparing various types of surveys and enforcement actions (COVID-19-related; “routine” Medicare and Medicaid certification surveys; state licensure surveys) and possible options for challenging findings.
