American Lawyer Media Publishes 18th Edition of Insurance Bad Faith in Pennsylvania by Post & Schell Insurance Group Chair Richard McMonigle

Philadelphia, PA – April 10, 2018 –American Lawyer Media (ALM)/The Legal Intelligencer have published and released the 18th Edition of Insurance Bad Faith in Pennsylvania, the authoritative resource for overview and analysis of bad faith cases in the Commonwealth of Pennsylvania. The book, first published in 1999, is authored by Post & Schell Principal and Insurance Law Department Chair Richard L. McMonigle, Jr.

With forewords by Hon. Edward N. Cahn (Ret.) and Joseph R. Roda, Esq., the 18th edition examines key issues relating to bad faith lawsuits under Pennsylvania's common law and under Pennsylvania's "Bad Faith Statute,” 42 Pa.C.S.A. §8371.  For nearly twenty years, Insurance Bad Faith in Pennsylvania has been the go-to authority on the subject of insurance bad faith for practicing attorneys, claims professionals, judges, and law clerks.

“Although the bad faith statute has been around now for nearly 28 years, insurance bad faith continues to be a dynamic area of the law in the state and federal courts in Pennsylvania,” said Mr. McMonigle. “In 2017, the Pennsylvania Supreme Court in Rancosky v. Washington National Ins. Co. finally, and authoritatively, settled the question as to what must be proven, by clear and convincing evidence, to establish bad faith on the part of an insurance company. And just this week, in Berg v. Nationwide Ins. Co., the Superior Court overturned the largest personal lines bad faith verdict ($21 million) in Pennsylvania history. So it’s never dull in this area of the law!”

Mr. McMonigle’s national insurance practice focuses on the defense and trial of first and third party insurance matters involving complex insurance coverage issues and allegations of bad faith claims handling.  A seasoned litigator, he also provides training to claims professionals and attorneys on the subject of good faith claims handling.

In addition to authoring Insurance Bad Faith in Pennsylvania, Mr. McMonigle is the co-author along with Principal Lindsay B. Andreuzzi of ALM’s Insurance Bad Faith in New Jersey, now in its 4th Edition, the authoritative single-volume collection of New Jersey law on bad faith litigation.
