American Lawyer Media Publishes 17th Edition of Insurance Bad Faith in Pennsylvania by Post & Schell Insurance Group Chair Richard McMonigle

Philadelphia, PA – January 26, 2017 –American Lawyer Media (ALM)/The Legal Intelligencer have published and released the 17th Edition of Insurance Bad Faith in Pennsylvania, the authoritative resource for overview and analysis of insurance bad faith cases in the Commonwealth of Pennsylvania. The book, first published in 1999, is authored by Post & Schell Principal and Insurance Law Department Chair Richard L. McMonigle, Jr.

With forewords by Hon. Edward N. Cahn (Ret.) and Joseph R. Roda, Esq., the 17th edition examines every important issue relating to bad faith lawsuits under Pennsylvania's common law and under 42 Pa. C.S.A. §8371- Pennsylvania's "Bad Faith Statute." Insurance Bad Faith in Pennsylvania is designed for practicing attorneys, claims professionals, judges, and law clerks.

“Pennsylvania’s bad faith statute is now over a quarter-century old,” said Mr. McMonigle. “Although many legal issues have been determined by the courts over that period, there remain unsettled questions which continue to challenge the state and federal judiciary, and those of us who have the privilege of practicing in the area of insurance law in Pennsylvania.”

The 17th Edition of Insurance Bad Faith in Pennsylvania includes:

-Over sixty (60) new court opinions briefed and discussed.

-Summaries of all significant bad faith cases, organized by category.

-Discussion of the impact of recent important court decisions

-In-depth analysis of the hottest topics in the field:

  • Continuing debate over severance and bifurcation in post-Koken UM and UIM claims.
  • Disputes over delay in payment and settlement negotiations.
  • Claims for compensatory and consequential damages.
  • Strategic considerations in presenting, and defending against, bad faith claims.

-The questionable expansion of first- and third-party common law bad faith.

-The latest court decisions dealing with the discoverability of claims handling documents, and protection afforded for attorney communications and work product.
