Overview
Post & Schell’s Legal Ethics and Disciplinary Defense Practice Group represent law firms, general counsels, and government and private-practice lawyers in every phase of disciplinary enforcement actions brought by The Disciplinary Board of the Supreme Court of Pennsylvania. They also counsel lawyers on issues related to the unauthorized practice of law, firm organization (including formation, partnership agreements, and firm dissolution), and conduct highly sensitive internal investigations for law firms.
The Group’s white-collar criminal defense experience is brought to bear when lawyers are subjects of government investigations and to address prosecutors who increasingly view lawyers as a source of evidence against law firm clients. We have also counseled lawyers in criminal investigations and reviewed subpoenas for documents or testimony about client matters.
Our work includes representation of law firms and lawyers involving allegations of:
- Brady violations
- Conflicts of interest, including disqualification motions and actual lawsuits
- Criminal investigations
- Disputes with departing partners
- Disciplinary proceedings for law firms and individual lawyers
- Errors at trial
- Fee disputes
- Negligence in drafting transactional documents
- Negligent litigation advice
- Overbilling
