Carolyn Kendall Discusses Prosecution of PA Wage Theft Cases with Law360

In the April 27, 2021 article, "Pa. Wage Theft Cases Put Employers On Notice, Attys Say," in Law360, Carolyn H. Kendall discusses the rising risk of prosecution in wage theft cases in Pennsylvania.

The article notes, "while traditionally seen as matters reserved for civil enforcement, alleged violations of state labor laws have been increasingly drawing the ire of (PA) Attorney General Josh Shapiro and local prosecutors who see them as predicates to file criminal charges against companies and their executives."

Ms. Kendall notes:

"These cases highlight a real and substantial risk in my view not just to employers in the construction industry where we've seen it crop up so far, but across the board. I'm sympathetic to the view that this is the criminal enforcement arm of the government invading the providence of the regulatory, but I guess we'll have to see if courts share that concern."
