Energy Compliance

Post & Schell’s Energy Compliance Practice Group includes attorneys from the Firm’s Energy & Utilities and Internal Investigations & White Collar Defense Practice Groups. Our attorneys have extensive experience advocating before the Federal Energy Regulatory Commission (FERC) and the U.S. Departments of Energy, Transportation, and Justice, as well as before the Pennsylvania Public Utility Commission (PPUC). They include former FERC and PPUC staffers, former federal prosecutors, as well as attorneys who previously clerked for federal and state appellate judges.

The Energy Compliance Practice Group provides clients with: 

  • Comprehensive compliance and best practice programs, plans and training
  • Internal investigations to assess compliance issues
  • Evaluation and negotiation of voluntary disclosures to relevant government agencies
  • Drafting and compliance review of pipeline transportation and construction contracts
  • Counsel related to capacity use and associated compliance
  • Counsel related to tariff requirements and compliance
  • Defense of company, directors and/or officers during federal investigations and in civil or criminal trials and/or appeals

Representative Experience:

  • Conducted FERC and CFTC compliance training for shared services employees who work on interstate natural gas pipeline and local natural gas distribution company matters
  • Counseled a number of oil pipelines on a comprehensive range of FERC compliance requirements
  • Prepared and revised FERC compliance plans for natural gas companies and oil pipelines 
  • Counseled local distribution companies on a broad range of FERC capacity use, jurisdictional and other compliance issues
  • Counseled interstate natural gas pipelines on open season and tariff requirements  
  • Reviewed interstate natural gas pipeline tariffs for inconsistencies with FERC policy and regulations
  • Reviewed interstate natural gas pipelines’ transportation contracts for nonconforming provisions and prepared the FERC filings requesting approval of the nonconforming contracts
  • Counseled electric utility on transmission siting regulations
  • Counseled interstate natural gas pipelines and local distribution companies on FERC certificate requirements 
  • Counseled various types of entities on liquid natural gas (LNG) construction, natural gas exports, interstate natural gas pipeline construction and natural gas exchange transactions  
  • Conducted internal investigation and represented natural gas company in a self-reported FERC compliance violation 
  • Collaborated with in-house utility counsel on an internal investigation related to a pipeline leak monitoring
  • Represented companies in dealing with FERC Enforcement Staff in response to Hot Line complaints
  • Represented a natural gas company in resolving PHMSA compliance issues    
  • Advised state-regulated local gas distributors on state efficiency requirements   
  • Advised natural gas distributor on Pipeline and Hazardous Materials Safety Administration requirements
