Legal Malpractice Defense

Post and Schell has a team of lawyers dedicated to the defense of Legal Malpractice claims. These lawyers have significant experience in handling these cases and, have taken numerous cases to jury verdict in numerous jurisdictions throughout the Commonwealth. Cases involving alleged legal errors are often factually and legally complex and are a professional challenge to our lawyer clients. Our use of experienced counsel allows us to assure our clients that their matter will be handled in a thoughtful, aggressive and effective manner.

Our case experience includes the defense of matters grounded in a myriad of legal disciplines. We have defended cases ranging from alleged errors in commercial cases, workers' compensation, personal injury/wrongful death, business law, environmental matters, white collar defense and construction/casualty. Our firm’s broad based practice is a valuable asset to our defense team as they prepare a defense that includes an analysis of the "case within a case". We are able to call on specialists from varied practice groups and industry sectors to ensure a complete and fact sensitive defense. Further, our extensive work in varied legal areas affords us access to an excellent and far reaching pool of experts.

Our Legal Liability defense team has a broad geographic reach. Members of our group are resident in our Philadelphia, Allentown, Lancaster and Princeton offices. Each of these team leaders has jury trial experience in those geographic areas. Our geographic scope assures that important elements of local practice will be seamlessly addressed. Combined with our firm's extensive technology, including streaming video and video conferencing capabilities in all of our offices, we are able to bring significant resources to the defense of these matters, regardless of jurisdiction.

Post and Schell also has an experienced Appellate Department. We employ lawyers from this department as an integral component of the defense team, so that appropriate issues can be preserved, analyzed and litigated as needed before, during and after trial.

The Professional Liability Department intentionally keeps caseloads small, so that each matter will be proactively and aggressively defended. This approach helps leads to prompt dismissal of cases without merit and early settlement of meritorious cases through negotiation or mediation. For those cases that require trial, our lawyers have the expertise and experience to expertly present a thoughtful and reasoned defense.
