Matt Newcomer Serves as a Speaker on Off-Label Marketing at the ABA's Washington Health Law Summit on Dec. 5
On Tuesday, December 5, 2017, White Collar Principal Matthew T. Newcomer served as a speaker on the panel, "Off-Label Marketing as Protected Free Speech — Case Law and Policy Update," at the American Bar Association's (ABA) 2017 Washington Health Law Summit at the Ritz-Carlton in Washington, D.C.
The panel discussion examined recent federal court decisions on legal restrictions for off-label information. These decisions have applied a heightened degree of First Amendment scrutiny impacting the government’s ability to criminally prosecute off-label promotion. FDA has been examining its position on off-label and on-label communications as a result of these decisions, as prompted by Congress. The panel also addressed the quickly shifting status of the law and discussed implications for health law practitioners.
