Casualty Litigation E-Flash Update PA Attorney General Appeals Commonwealth Court Decision Striking Fair Share Act   As a follow up to our message last week, be advised that the Attorney General's Office has, as expected, filed an appeal from the Commonwealth Court's order on July 26, 2005 which declared the Fair Share Act to be unconstitutional. The filing of that appeal on August 1 stays the Commonwealth Court's order until final resolution by the Pennsylvania Supreme Court. Trial courts should continue to apply the Fair Share Act pending completion of the appeal process.
